A Basingstoke man is suing his council for £50,000 after tripping over a wonky paving stone and sustaining personal injuries which resulted in part of his foot having to be amputated.
Daryl Phillimore, 43, fell while walking his dog two years ago, claims he had warned the authority about loose slabs near his home. Daryl said: “I had complained two or three times that kerb stones and edging stones were broken and a hazard to pedestrians. One day I tripped over one. I was told I had sprained my ankle.
“But the next day I was in agony and I went back to hospital. I came out five weeks later minus three toes and a quarter of my right foot. It had become infected and the doctors said it had to be amputated. Now I can’t work properly. It is only fair the council compensates me.”
The painter and decorator has to attend a foot clinic every three weeks and needs his family to care for him. He is claiming damages from the County Council for personal injury and trauma.
Dad Tony Phillimore, 76, said: “We warned the council. They have only just replaced and repaired the paving stones.” Council leader Ken Thornber said: “Proceedings have been issued so we are unable to make any further comment.”
